These terms apply when you request trial setup, access AimVisible, connect a marketing account, or authorise AimVisible to prepare or carry out work for your business. AimVisible is operated from Sydney, Australia. In these terms, "we", "us", and "AimVisible" mean the AimVisible service, and "you" means the person or business using it.

Business use only

AimVisible is a business product for ecommerce and marketing operations. You confirm that you are using it for business purposes and that you have authority to act for the business, workspace, ad account, store, email account, or other connected system you ask us to access.

Trial setup and onboarding

Trial setup is a guided service. We may ask for business information, website details, platform access, and approval preferences so we can configure your workspace and prepare recommendations. A trial does not guarantee a specific revenue outcome, marketing result, ad approval, platform approval, or increase in sales.

Connected accounts

When you connect Shopify, Klaviyo, Meta Ads, Google Ads, GoHighLevel, or another platform, you authorise AimVisible to read the data needed to provide the service. Where the product supports approved actions, you also authorise us to make the specific changes you approve. You are responsible for keeping access permissions accurate and removing access when you no longer want the service connected.

For Google Ads, you confirm that you have authority to grant AimVisible access to the Google Ads customer account or manager-account relationship. AimVisible may read campaign performance data, prepare recommendations and apply approved changes such as budget edits, keyword changes, negative keywords, campaign drafts, ad copy updates or campaign status changes. You remain responsible for your Google Ads account, policy compliance, billing and media spend.

Approval before launch

AimVisible is built around approval. Drafts, recommendations, reports, and campaign changes are provided for review unless we have separately agreed in writing that a specific class of action may run automatically. You remain responsible for checking that approved copy, offers, targeting, budgets, claims, and creative are accurate and suitable for your business.

Acceptable use

You must not use AimVisible to break the law, mislead customers, infringe intellectual property rights, send unlawful spam, upload malicious code, attempt unauthorised access, interfere with the service, or submit content you do not have the right to use. We may suspend access if we reasonably believe the service is being misused or your use creates legal, security, deliverability, or platform-policy risk.

Your content and data

You keep ownership of the business data, customer data, account data, and creative assets you provide or connect. You grant AimVisible the rights needed to host, process, analyse, transform, and display that material so we can provide the service. Our handling of personal information is explained in the Privacy policy.

Generated recommendations

AimVisible may use AI systems to generate recommendations, drafts, summaries, and campaign materials. AI output can be incomplete or wrong. You must review output before relying on it, publishing it, or approving changes based on it. We do not provide legal, tax, accounting, or financial advice.

Third-party platforms

AimVisible depends on third-party platforms including ad networks, ecommerce platforms, email tools, hosting providers, authentication providers, analytics tools, and AI providers. Their availability, rules, APIs, billing, moderation decisions, and account restrictions are outside our control. We are not responsible for outages, rejected ads, suspended accounts, changed APIs, or policy decisions made by third parties.

Fees and billing

If you move from trial setup to a paid plan, the fees, billing period, included services, and cancellation terms will be shown or agreed before billing starts. Unless stated otherwise, third-party platform spend, ad spend, app subscriptions, domain fees, SMS charges, email sending charges, and other external costs are separate from AimVisible fees.

No guaranteed results

Marketing performance depends on your offer, pricing, inventory, customer experience, market conditions, budget, platform delivery, and many other factors. We aim to improve the quality and speed of marketing decisions, but we do not guarantee profit, revenue, return on ad spend, lead volume, conversion rate, or any other commercial result.

Service availability

We work to keep the service available, secure, and useful, but we do not promise uninterrupted access. We may change, improve, restrict, or discontinue parts of the service as the product develops, provided we do not materially reduce paid services without reasonable notice or an appropriate remedy.

Confidentiality

Each party may receive non-public business information from the other. The receiving party must use that information only for the service relationship and must take reasonable steps to protect it. This does not apply to information that is public, independently developed, already known, or required to be disclosed by law.

Liability

To the maximum extent permitted by law, AimVisible is not liable for indirect, consequential, special, or loss-of-profit damages. Where liability cannot be excluded, our liability is limited to resupplying the service or refunding the amount you paid for the affected service period. Nothing in these terms excludes rights that cannot be excluded under Australian Consumer Law.

Cancellation and disconnection

You may stop using AimVisible at any time. You are responsible for disconnecting third-party accounts if you no longer want the service to access them. You can also ask us to delete your account and connected platform data by emailing hello@aimvisible.com.

Changes to these terms

We may update these terms as the service changes. If the change is material, we will give reasonable notice by email or in-product notice. Continuing to use AimVisible after the updated terms take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of New South Wales, Australia. The parties submit to the courts of New South Wales and the Commonwealth courts of Australia.
